Yeah he may have been looking for trouble, and probably was, but he knew the law and knew he hadn't broken any laws. Isn't that what lawyers do in court? You have the right to argue your point. Policemen don't make the laws they enforce the laws. The policeman might should have known the law.

The problem is several of the cases he quoted are simply favorable rulings not established caselaw.

He also misapplies Terry V. Ohio for reasons that we have discussed ad nauseum on this forum.

Personally I wouldn't have been as intimidated as the officer and his supervisor were in this case.

Some may see this incident as a victory, much in the same way that the O.J. Simpson acquittal was a "victory" for some segments of the population, but I think both see that in the long run it doesn't mean anything and simply prepares the other party to deal more effectively the next time around.

You can exercise your rights as long as you are not an activist? What's the definition of an activist? Someone who knows the law regarding their rights and can stand up for themselves?

Best I can figure out is that unless you have a justifiable need to open carry you are considered an activist.

If you intentionally blow smoke in my face you are assaulting me. If I am standing next to you with a firearm there is no assault.
Me standing next to you with a holstered firearm would be the equivalent of you standing next to me with an unlit cigarette.
