“The National Transportation Safety Board affirmed the agency's position that unmanned aircraft systems (UAS) meet the legal definition of ‘aircraft,’ and that the agency may take enforcement action against anyone who operates a UAS or model aircraft in a careless or reckless manner.”

So like a lot of other redundant laws, they will make new ones envelope and classify what these things are, even though they fit under the legal definition. This guy could be looking at federal charges for shooting at an "aircraft". I seriously doubt he's going to have any more trouble to anticipate because the FAA is still working to finish specific regulations on them

As a owner of a "Killer Drone" or "Pervcopter", I'm extremely familiar with the FAA rules and laws pertaining to RC Air Craft. Constitutional Case laws says private property owners only own 55ft of air space above their property from ground level. Also shooting at RC Airplanes/Quadcopters is considered a felony under the Federal Goverment's Laws.

I've some knowledge of this case, and the drone owner had a telemetry sensor installed with a OSD. He also was recording to a DVR setup, so all of this has been captured, and he's been proven innocent. He didn't even fly over the guys property, he was flying on land that he had permission to fly on. Also most cameras on these setups can't zoom in, nor capture fine details from a distance.
So any Pervecopter would have to be pretty close to the subject. The FAA says RC Aircraft can fly over ANY propery between 56ft to 400ft. That's our airspace.

I can be quite irritating and stay within the regs with a "REAL" plane if I know who is harassing me with a drone. :)

Citations, please. What case made it 55', and what law makes it a felony?

Here's a link to the flight record for the drone. It does't seem to be hovering around 20 something feet or less like the shooter stated, it also appears that it wasn't even above his property when shot, and only crossed his property for a 2 second duration at over 250' altitude.

Google map link with a pin on the shooters property.

I don't know about the 55' deal, but drones are technically an aircraft.

I found a couple definitions of an aircraft, from NTSB & International Civil Aviation Organization
Any machine that can derive support in the atmosphere from the reactions of the air other than the reactions of the air against the earth’s surface.
Here is a more generalized definition found from the FAA website
Aircraft means a device that is used or intended to be used for flight in the air.

18 U.S. Code § 32 - Destruction of aircraft or aircraft facilities

(a) Whoever willfully-
(1) sets fire to, damages, destroys, disables, or wrecks any aircraft in the special aircraft jurisdiction of the United States or any civil aircraft used, operated, or employed in interstate, overseas, or foreign air commerce;

Here's a link to FAA's website for info on Unmaned Aircraft, plenty of clicky's and info on this subject. Link
