Brake checked

What happens if someone in front of you does a brake check and you hit them? I’ve always thought it was the rear vehicle that was liable for the accident. Is that the still the case? Or are there circumstances where the brake checker would be liable?

There are YouTube videos showing drivers cutting off semis, then brake checking them and the semi hitting the vehicle. Then you can here the semi driver saying, well, that’s on video.

I've always thought that too.

Maybe if the brake check was obviously intentional it wouldn't be your fault if you rear-ended someone?

Talked about this one time with a cop friend. He said 98% of the time it's going to be your fault for "following to close".

Like mentioned above 98% of the time it is the one in the rears fault but if you have some way of proving that they did indeed brake check then its their fault but that is hard to prove unless you have a dash cam or someone witnessed it that has one.

Mine paid for itself shortly after I installed it.

I actually don't know anyone who does have one......just asked all my co-workers up here at Tinker and not a one of them. I can definitely see where it would help as proof, guess most just can't/don't want to justify the cost.

I love my dash cam. I've seen a bunch of near misses get recorded on it.

They are less than $100, this guy tried to lane check me(green car), then purposely hit me and ran. When I talked to the Officer responding the conversation changed when I showed him the cam footage, initially he just thought it was some . The other guy was tracked down and ticketed for what he did. It also saved me my deductible as SF covered both of us and felt it was fair to ask me to cover it. When I showed them the video they changed their tune. I haven't needed it since, but like the security for as much as I(used) to drive.
