I think a case could be made that everyone knows that texting while driving is dangerous, and could lead to a fatal accident. Willfully violating that law, knowing how dangerous it is, could be construed as first degree. It'd take a prosecutor willing to put that argument out, if, God forbid...

Plus, unless the people asking the questions have evidence that proves otherwise, they really are not able to do anything except take your word for it. The law works on what they can prove beyond a reasonable doubt.

If you're trying to deter ticks, and wear boots or long socks, try getting a pair of flea and tick collars and wearing them on your ankles. it sounds odd, but that's what we did when I was in the Army at Ft. Riley. Any trip to the field in spring/summer and you'd be picking ticks off every day...
