AGENCY: Bureau of Alcohol, Tobacco, Firearms, and Explosives, Department of Justice.
ACTION: Notice of proposed rulemaking; request for comment.
SUMMARY: The Department of Justice (“Department”) proposes amending Bureau of Alcohol, Tobacco, Firearms, and Explosives (“ATF”) regulations to provide new regulatory definitions of “firearm frame or receiver” and “frame or receiver” because the prior regulations failed to capture the full meaning of those terms. The Department also proposes amending ATF’s definitions of “firearm” and “gunsmith” to clarify the meaning of those terms, and to provide definitions of terms such as “complete weapon,” “complete muffler or silencer device,” “privately made firearm,” and “readily” for purposes of clarity given advancements in firearms technology. Further, the Department proposes amendments to ATF’s regulations on marking and recordkeeping that are necessary to implement these new or amended definitions.

This leaked draft document from the ATF is just about as clear as mud: Definition of “Frame or Receiver” and Identification of Firearms. So it appears that not only are they going to soon restrict 80% receivers, but they also want to call an AR-15 Upper Receiver a “firearm.” Just how this would be implemented is not clear. Would older uppers be grandfathered? Would buying a complete AR-15 require listing two “receiver” items on a Form 4473? Will lowers and uppers be serialized alike? Will lowers be legally “married” to uppers?

Where did you see “upper” mentioned?
I didn’t see it in his post. But in another post some days back it was mentioned that the ATF was looking at changing the upper half of an AR15 to the serialized park instead of the lower. Part of this stems from a case out in Cali were a guy was finishing out 80% lowers. Then completing and selling rifles. The case was dropped partly because the ATF didn’t want a ruling. This was because an AR15 lower doesn’t meet the complete definition of a receiver.
