The issue is whether he has the discretion to use excessive force to detain/arrest, that is out of proportion to the threat being posed in the moment. He doesn't. The force used by this officer on a slight, elderly man is wildly out of proportion to simply being touched by said man. What the officer used was force that could reasonably be expected to (and did) cause great bodily harm. Have you seen the photos of the man in the ICU bed?
