Did anybody figure out if TwinPeaks is a 51% alcohol business or not? I've been googling but I must not know the right words to put in.
Based on information posted in this thread, I'd say, IT DON'T MATTER even a little bit. At least it doesn't matter for a guy carrying a rifle. You can't carry a long gun anywhere that alcohol is consumed. It doesn't matter if 5% or 100% of the establishment's income comes from alcohol. The rules for carrying pistols are the same as they were.

I'm not a lawyer and I haven't even read the law itself. I'm just following guys like SMS because I'm a sheep, but also because I don't much care. If it's a restaurant I can carry a concealed pistol into it. If I'm an ******* (and I am) I can even carry my pistol openly, but I won't. (I'm not that big an *******.)

There are several restaurants I know that are run by teetotaling fundamentalist folk.
I'm thinking about carrying a rifle into one just so I can Feel the Power.

Atty relies on 1272 but ignores 1272.1.
Harper was ok with the pistol because he had a permit but is screwed on the rifle.
Still in jail because he wanted attention. Jail could use an audit.

His attorney must’ve received his law degree from a school advertised on the back of a box of that Twinkie cereal....

That article is a mess, as are the AG’s comments. Business owner rights are not relevant to expressly outlawed actions. You can’t carry a rifle into a place where alcohol is served/consumed, even if the business doesn’t mind.

Why is the AG talking about trespassing when the guy was charged under 1272.1?

The scary thing is that his attorney is the US Lawshield attorney for Oklahoma and my opinion on this is that he is *dead wrong* on his assertion of the law. If you are going to be a 2A attorney, you need to KNOW that law like the back of your hand and his statement shows that he fails to comprehend the absolute black letter law that is not in the least bit ambiguous. I would NOT have said what he did for fear of a malpractice suit.

Edit: Robles has been practicing law for 30+ years and graduated from OU Law in 1980. All his 2A videos on YouTube have been set to private.

@HeyEng I saw him speak a couple times this year. Once early in the year on the new law, he seemed to know what he was talking about quoting the law line and verse. The second time was a couple months ago. He was basically saying you could have a green card and carry. All you needed to do was get a Cleet license to be a security guard and since the state passed the law about not discriminating against those that had green cards you would be clear. I ain't no lawyer and haven't been in a Holiday Inn latley but that sounded like terrible advice to me. I didn't see what a state law had to do with Federal Law and Form 4473 - 11.E
Are you an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance? Warning: The use or possession of marijuana remains unlawful under Federal law regardless of whether it has been legalized or decriminalized for medicinal or recreational purposes in the state where you reside.
