Well technically him assaulting her which caused her self defense was a crime...but thats splitting hairs. She should not have fled the scene. Maybe get in your car and drive to a safe location a block or two away and call the police. Taking pics with the cell phone was just odd. This woman just happened to have a loaded rifle ready to rock in her trunk? Does that require CC permit in TX? Did she have one? If not she wouldn't have had the gun in the first place and she couldn't have shot him. How does the law view that? Is she auto-guilty? Like (I believe) how the law views drunk driving? If someone rear ends you at a stop sign, but you're drunk, it's your fault. I don't think this is as cut and dry as some here who have posted so far make it seem. The woman pulled the rifle because the man was making comments, she has apparently stated this(at least the articles and coverage I've seen stated she made that statement). Since when is making suggestive comments threatening your life? There'd be lots more dead guys if that were the case. He only attempted to hit/stab/whatever her after she's pulled her gun. Game on at the point where the gun is revealed for both parties. If someone draws a gun on me I have to assume they plan to use it. Sight of that gun would be enough for me to go ape on her. The guy, Poochie, clearly wasn't a nice guy. Nice guys don't harass women at gas stations. He's also a complete idiot. "Uh, yeah I'll just continue to stand here while you retrieve your rifle from the trunk of your car and hold it at low ready." As soon as he saw the rifle he should have made a decision: A. Beat her senseless, stab her, whatever you have to do to neutralize the threat. I am staunchly against hitting women...until they pull a gun on you. B. Thow yo hands in da ayerrrr and back away slowly telling her you are sorry. This probably doesn't guarantee you don't still get shot (da wimenz be cray cray) but at least self defense is nearly impossible to be used as a legal defense in that case. Unless as you are backing away you are spouting off crap like "I know where you live, I will be waiting for you later...etc"
