Funny how they always advocate for more taxes rather than figure out a way to make ends meet. I'm going to try this with my boss. "My family and I voted, you need to pay me more." Does her point have validity about pay by mile being unconstitutional? Yes. However when has that ever stopped a government? Only after years of fighting. Even if found unconstitutional I am certain no one will get refunds if passed...

Wayfair v South Dakota proved the government will find it constitutional if its in their best interest to do so.

This lady is advocating that a tax-by-mile legislation (either state or federal) is unconstitutional and is citing Crandall vs State of Nevada (from the 1800's) as the reason why.



In all honesty, I know nothing about this lady nor the SCOTUS ruling in Crandall vs State of Nevada. Has anyone else got an opinion on the validity?

As I understand it (not an attorney), it would more likely apply to California's law of taxing people that leave the state. I think this law was more about traveling out of state, rather than miles of infrastructure used.

Nope. Right in the first part of the video, she mentioned the federal bill that included the tax by the mile. She referenced the $1.2 Billion Infrastructure bill, so this is not about California's ideas.
