If the court feels an issue has been addressed in another way (state or federal court, for example) it may not take up the case. That it is state vs state is just a faster way to the SCOTUS, but doesn't mean they must rule on it. Pointing to other litigation would also be a good way for the court to avoid the politics of the situation.</p></blockquote><p></p>
