If a Taser is considered 'Less Than Lethal' force, it may be difficult to articulate the threat. I suspect you could argue that incapacitation would render you defenseless, and that would cause me to 'fear for my life.'

There is also a argument that LE personnel are trained and/or certified to employ Tasers as less than lethal force. You do not have that understanding with criminal use.

It is less lethal not "less than lethal" people die every year from taser deployment!

Would the "great bodily harm or possible death" argument fly? I'm also wondering if the primary argument from the BG's families' civil suit would be you could have avoided the attack by running away.

Of course, GC has a sworn duty, even if he is "off duty" but not me. And I don't think I could outrun a man on crutches at this stage of my life, much less a young, able-bodied person hellbent on robbing me.

Many moons ago, we were trained that if someone pulled a Taser/stungun on us were were in mortal danger, as we could be incapacitated and vulnerable to lethal attack/disarmament.
