This is great information and very timely for me. My father passed just over a year ago and Mom and I are trying to get things setup so there are no issues when her time comes. For the record, I am an only child so it should make things a lot easier.

I applaud Dave for taking the time and making the effort to post as many comments (avoiding the phrase “legal advice” here) as he has regarding probate, trusts, wills, and the like. I’ve learned quite a bit reading this thread, and I look forward to the other threads.

OK I'm just gonna say I hate Hate HATE rich peoples!

I'm working some land that was owned by the president of Agricultural and Mechanical College at College Station. His brothers wife's Will had seven Condicils and was 56 friggin pages. She divided up her schiz amongst her kids, grand kids, nephews, nieces and I think the neigbor's dog got in on the action. Of course each kid had a choice and those contingencies applied to all the lower tiered devisees and they weren't covered in the order.

That was just one of that bunch!
