With our present system that allows pretty much every lawsuit, no matter how frivolous, it's almost a given that the homeowner will be sued. Criminal charges are another matter. Unfortunately in COMMIEfornia that is also a real possibility.

Chances are Provoste doesn't have health insurance so the tax payers are on the hook for his ER vist. Chances are he doesn't have money for a lawyer so a public defender will be assigned, tax payers on the hook again. He will be convicted and go to prison, tax payers on the hook again. It is possbile that an aggressive young attorney might take a lawsuit case against the homeowner pro bono, not much to lose and some to gain.

If the Prosecutor believes he/she can convince a jury that the homeowner did more than was necessary he/she will file charges. If the homeowner really is a "homeowner" he probably won't qualify for a public defender so his bail and lawyer fee's will come out of his pocket. Sometimes people find themselves between a rock and a hard place financially in these circumstances and for no other reason are forced into a plea bargin.

Or maybe nothing will happen...........it's kind of a roll of the dice isn't it.
