Delaware attorney general strips county sheriffs of arrest powers

Sheriff Jeff Christopher of Sussex County, Delaware, when he was elected to the office in 2010, thought he was handpicked by the people to represent them as the highest-ranking law officer in the county. Instead, he has found himself in the middle of a fight for the future of American law enforcement as a result of a nationwide effort to abolish the sheriff’s office altogether.


It is one more example of federal and state governments ignoring the will of the people as well state laws. In the case of Delaware, the state’s own constitution stipulates that the office of the sheriff is a constitutionally created position just like the secretary of state and the attorney general. Delaware’s Constitution states: “The sheriffs shall be conservators of the peace within the counties . . . in which they reside.”

This is likely a direct result of local sheriffs saying they will not enforce new gun laws. The survival of the constitution resides solely in the hands of the SCOTUS, which scares the crap out of me, all it will take is one more obama appointee and it all changes.

After reading a little more on this, the state of Delaware has never granted the sheriff's offic arrest powers. They didn't take them away, rather this particular sheriff has been trying to obtain the ability to arrest people. The story is a little misleading in the title, arrest powers have never been a part of Delaware's Sheriff offices. This county has been fighting for arrest powers for years, to no avail. THey are limited to handling forclosures and serving papers. Seems a bit ridiculous for a sheriff to be a glorified process server.

I think they should have the arrest power. In a recent drug bust, a deputy arrested a dealer with a crap ton of drugs and the judge dismissed the case because the deputy does not have the legal right to arrest someone.

Yeppers. We're headed for some hard times. And I'll bet a lot of gun owners never thought molon labe would ever become a literal concept. Turns out it's going to become much more than a bumper sticker.
