Yes it is
Congress did pass a law. Bipartisan Safer Communities Act (BSCA) Passed in 2022. This law expanded the definition of “engaging in the business”. If you engage in the business, per their guidelines, you need a FFL. The AG said this new rule is in compliance with that law.
