You don't in Oklahoma. (Kentucky, however, does not recognize common law marriages.)

It's not necessary for him to do anything.
He can simply trade places with one of the other deputy clerks and allow them to issue the license...
Now that Ms Davis is not there to preclude issuing of licenses altogether.

nice, but that would seem to assume that banning gay marriage was legitimate to begin with.

Separate but equal was once viewed as legal and just. Now it is not.

Perhaps scalia is right. Perhaps not. Like with all supreme court decisions, time will tell which side is correct.
