See the Dept of Justice letter regarding gun purchase and ownership for those with a medical marijuana card within the story.

According to the letter, those with a card must answer yes to the 4473 illegal drug question because possession and use is still illegal under federal law......answering no to the question would be making a false statement which is a federal felony.

That question has been on the 4473 for over a year now.

That letter is from 2011, I bet there’ll be a newer version here soon
Nope. 18 U.S.C. 922(g)(3) hasn't changed; it's still illegal. I've posted the text and link in a couple of other threads, and I'm not in a place where it'd be easy to look up right now.

Strictly speaking, having a card isn't disqualifying; use is disqualifying. However, having the card would be used as prima facie evidence of use, and it's kind of a hair-splitting argument. I wouldn't enjoy trying to make it stick.
