Seems like NM is trying to do something about civil forfeiture. But the GOP in WY seems to be spineless and gutless on the subject of civil forfeiture.(see link in article).

..."New Mexico police must now convict you of a crime and prove your property was used in the crime before you forfeit it to the authorities. Also, the money gained from the property will now go to the state’s general fund instead of police budgets, so that police do not have incentives to take from citizens."...

About time. Allowing the police to directly profit from seizures creates perverse incentives in favor of aggressive seizure policies, doubly so when the legitimate owner is charged with proving his innocence, instead of the state being required to prove guilt.

Loretta Lynch(Obama’s nominee for attorney general) during her Senate confirmation hearing called Civil Asset Forfeiture(CAF) a “wonderful tool” for law enforcement----and spreading the wealth:rollingla:rollingla(my emphasis/IMHO). :nono2::nolike::censored:

Department of Public Safety warned that the lack of asset forfeiture funds would result in “less training, less resources, less equipment, and a reduction of criminal investigations.”

If we can't take peoples stuff, we can't train or investigate. Roll the violin music.
