AMENDATORY 29 O.S. 2011, Section 4-135, is amended to read as follows:</p><p>Section 4-135. A. The Department of Wildlife Conservation is authorized to issue permits to landowners, lessees, or their designated agents and to any entity of state, county, or local government to control nuisance or damage by any species of wildlife including, but not limited to, beaver, coyote, deer, bobcat, raccoon, and crow under rules promulgated by the Oklahoma Wildlife Conservation Commission. The permits may be issued without limitation by statewide season regulations, bag limits or methods of taking. The Department is authorized to issue permits for hunting feral swine with a firearm sound suppressor to any landowner, lessee or designated agent of the landowner or lessee who is authorized to possess a firearm sound suppressor, as evidenced by payment and possession of the required federal tax stamp issued by the Bureau of Alcohol, Tobacco, Firearms and Explosives. Such a permit shall be for hunting feral swine between the hours of one-half (1/2) hour before sunrise to one-half (1/2) hour after sunset only. A permitted landowner, lessee or a designated agent of the landowner or lessee may, with a valid permit issued pursuant to this section, control the wildlife specified in this subsection and feral swine at night to protect marketable agricultural crops, livestock, or processed feed, seed or other materials used in the production of an agricultural commodity.</p><p>B. Except as otherwise specified in this subsection, the permit to hunt at night shall be valid for a period of up to one (1) year from the date the permit was issued. Each landowner, lessee, or designated agent with a valid permit shall be required to have a current agricultural exemption permit issued by the Oklahoma Tax Commission.</p><p>C. Notwithstanding the provisions of Section 5-203.1 of this title, a landowner, lessee, or designated agent of the landowner or lessee with a valid permit may use a headlight carried on the person while hunting at night. Nothing in this section shall authorize the use of a headlight mounted on a vehicle or the use of a headlight from a public roadway.</p><p>D. Any person who has been convicted of, or pled guilty to, a violation of Section 5-203.1 or Section 5-411 of this title within the previous three (3) years shall not be eligible to receive a permit pursuant to this section. The permit can be issued by the local game warden in the county for which the permit is to be used or by the Law Enforcement Division of the Department of Wildlife Conservation.</p><p>E. Notwithstanding the provisions of Section 1289.13 of Title 21 of the Oklahoma Statutes, it shall be lawful for any private landowner or designated employee of the landowner or lessee to have a chamber-loaded firearm on property owned by the landowner, and to use the firearm for the purpose of controlling nuisance or damage by any wildlife or feral swine. Nothing in this section shall authorize any convicted felon to carry a firearm.</p><p>SECTION 2. AMENDATORY 2 O.S. 2011, Section 6-603, is amended to read as follows:</p><p>Section 6-603. As used in the Feral Swine Control Act:</p><p>1. "Daylight" means the period of time beginning when the sun rises and ending when the sun sets;</p><p>2. "Feral swine" means any hog, pig, or swine species (Sus scrofa) including, but not limited to, Russian and European wild boar that are running at large, free roaming, or wild upon public or private lands in this state;</p><p>3. "Owner" means any person with title to the real property or a person that has obtained a right to the possession and use of a certain space, property, or subsurface right for a definite period of time through a contractual lease. In the event a person is permitted to come upon the real property to perform some specific act including, but not limited to, hunting, removing feral swine, or fishing, that person has no "lease" but only a "license" to do that act; and</p><p>4. "Remove" means to change the location of, eliminate, or attempt to eliminate feral swine by a variety of methods including, but not limited to, hunting, killing, taking, trapping, and catching; and</p><p>5. "Judas pig tagging system" means a population control technique where a radio-collared feral swine is released into a control area and, after a sufficient period to allow it to join other feral swine, it is tracked down and all swine associated with the collared swine are removed.</p><p>SECTION 2. AMENDATORY 2 O.S. 2011, Section 6-609, is amended to read as follows:</p><p>Section 6-609. A. The State Board of Agriculture shall promulgate rules for the testing and intrastate movement of live feral swine.</p><p>B. All persons that transport live feral swine in this state shall be required to obtain a transporter license from the Oklahoma Department of Agriculture, Food, and Forestry.</p><p>C. Live feral swine shall only be transported to the following:</p><p>1. A licensed sporting facility;</p><p>2. A licensed breeding facility;</p><p>3. A licensed buying station;</p><p>4. A licensed gathering station;</p><p>5. Directly to an approved market or slaughter facility; or</p><p>6. Pursuant to an order issued by the State Veterinarian; or</p><p>7. Private land for the express intent of utilizing the Judas pig tagging system.</p><p>SECTION 3. AMENDATORY 2 O.S. 2011, Section 6-611, is amended to read as follows:</p><p>Section 6-611. A. No person shall intentionally or knowingly release or engage in, sponsor, instigate, assist, or profit from the release of any hog, boar, swine, or pig to live in a wild or feral state upon public or private lands, except for release:</p><p>1. Release into a licensed sporting facility pursuant to the Feral Swine Control Act; or</p><p>2. Release onto private land for the express intent of utilizing the Judas pig tagging system.</p><p>B. No person shall knowingly or intentionally violate the importation, testing, permitting, licensing, and transportation requirements contained in the Feral Swine Control Act and rules promulgated thereto.</p><p>C. Any person violating the provisions of this section is guilty of a felony and subject to a maximum punishment of two (2) years in prison, a fine of Two Thousand Dollars ($2,000.00), or both fine and imprisonment.</p><p>SECTION 4. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 6-613 of Title 2, unless there is created a duplication in numbering, reads as follows:</p><p>A person shall not be considered the owner of a feral swine if, within a twenty-four-hour period, the person catches, tags, and releases the feral swine in the same location that it was caught.</p><p>SECTION 5. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 6-614 of Title 2, unless there is created a duplication in numbering, reads as follows:</p><p>Recognizing the success of other states, like Mississippi and New Mexico, utilizing the Judas pig tagging system, the Legislature encourages using the Judas pig tagging system as an effective technique of hunting and controlling the feral swine population.</p><p>SECTION 6.
