From the video I saw, it appears the judge fired as the attacker was running away, no longer presenting a threat
The assailant had shot the judge several times in the stomach at point blank range. Both the judge and a probation officer returned fire at the assailant.

I think that video is a great example of why we are our own protection until the police arrive. A judge essentially on the steps of the courthouse with officers stationed there and they still couldnt respond until after the assault on the judge was over. No fault of the officers, but 15-20secs makes ALL the difference in the world for any third party to hear gun fire, respond, assess the threat, and engage.
