Dude #1 posts a microphone for sale online. Dude #2 comes over to check it out, but ends up taking it and fleeing in his vehicle. So, dude #1 did the most logical thing: Got his gun and fired two shots at the fleeing pickup.

If he is fleeing, he isn't a threat. You cannot execute people for stealing from you.
This guy saved his microphone, but he may have just mortgaged his familys future to pay a good 2a defense lawyer $100,000 to try and save his bacon.
