Meh, the 1994 Omnibus crime bill banned importing shotguns with more than a 5 round tube. That was the case for Benelli. That Beretta got away with it with a much newer model, just means the ATF wasn't looking. This is NOT a new thing.

I read somewhere the mag tube extensions were added at their TN factory after the gun was imported. Or maybe it was in a video. If that's true 922(r) shouldn't be an issue with importation.

And the ATF has a habit...a very annoying habit...of looking at something and saying it's legal, only to turn around later and say it's not legal.

And just because it's NOT a new thing doesn't make it right.

922 (r) compliance specifies that if you put on a "longer tube" on an import shotgun you also have to have at least 3 U.S. made parts to bring it into compliance. So to meet the criteria for Beretta to "legally" put a tube on it it would need a US manufactured hammer, trigger, and extractor as an example. Since there are no US manufactured parts for this shotgun they were not in compliance so ATF said no by following their ruling from 30 years ago.
Right, wrong, stupid or not Beretta knew this and was just trying to to fly under the radar. I can guarantee they knew, because when Benelli started their 3-gun series of M2s and M4s we all had a big meeting with Benelli and Beretta on how to handle the problem. In this case the ATF didn't suddenly decide to stop them, they have been enforcing this for 30 years

It amazes me how the ATF and other Government institutions give the 2nd Amendment very little thought as the 2nd Amendment is very clear that the Government cant have weapons stronger or bigger than the Citizens. This right certainly gets trampled 24 hrs a day. We need to get our politicians up to par on what is actually written in our Constitution and make sure they follow it while make and debating laws that are being made or used. We need a group that does nothing but audit our laws to make sure they are in compliance with our Constitution.
