C & R Question ?

C&R stuff sure isn't very clear. Sure you have a FFL, but if you sell part of you Collection, do the same rules apply as if you are a commercial dealer, or, own an establishment to sell guns ?
To some old folks like me this stuff gets confusing.

The way I look at it is that it helps you BUY guns. Just never sell them and you are good to go. :)

I did hear of a guy who set up a LLC and then it got the C&R license. As soon as it bought the guns, it "transfered" them to him personally. So he as the private purchaser and subsequent seller was not selling as an FFL.

Seems to me that being a LLC indicates that you are trying to operate as a business, which is illegal for a C&R licensee to do. Especially since his records would show they transferred the firearms to a private individual as soon as they got them. A C&R license is issued to an individual to collect curio and relic firearms and improve their collection, not to engage in a business.

It would seem like that but it is approved by the BATFE. I think its a way to have multiple people legally able to accept the weapons.

Please provide a link showing it is legal? If it is legal then you would have to list every person who was in the LLC (which the BATF would want to know) and could then legally transfer firearms only to them. If they were not part of the LLC then you would be in a business which is illegal. Trying to get around the rules sometimes gets you in trouble.

You do have to list every person involved, its even listed right on the application for the C&R license.
