Cuomo also made the point that low-level county officials like a clerk are not free to interpret the law for themselves but should leave that to elected accountable officials and/or judges. I think that is a valid point but it has limits - even a low-level official still has a right to oppose what he feels is blatant disregard for the Constitution but the case better be egregious and he should understand that his job is NOT protected.

Most County Clerks are elected, are they not? This is NY of course, so Lord only knows what else they screw up. :rolleyes2

Its possible that clerks are elected but I believe that Cuomo's context was legislative, executive, and judicial officials vice the county clerk, water commission officials, etc. who are not elected to influence policy but merely to execute specific low-level functions.

If I'm elected and my official duties include applying policy, I might be expected to have a little latitude in how that gets implemented, to include assigning priorities. Administrations do this daily all over the country, from the cop on the beat all the way to the Attorney General of the United States. Methinks Cuomo doth protest too much.
