Judge refuses to dimiss charge against Oklahoma City pharmacist Jerome Ersland


Oklahoma County District Judge Tammy Bass LeSure today refused to dismiss the murder charge against Oklahoma City pharmacist Jerome Ersland.

Judge refuses to dimiss charge against Oklahoma City pharmacist Jerome Ersland Ersland shot 16-year-old Antwun Parker in the head, knocking him unconscious, during an attempted robbery in May 2009.

Ersland is accused of accused of shooting the would-be teen robber five times as he lay unconscious on the floor

The pathologist who performed the autopsy described the head wound as nonfatal. But other pathologists who have reviewed the case say they would not have classified the shot as nonfatal.

Prosecutors maintain there is physical evidence that Parker was alive when the second volley of shots were fired.

Ersland's trial is set to begin Sept. 13.

While I do not agree with Ersland's conduct, it certainly appears his defense team has enough to cause reasonable doubt in the mind of a jury. Unless the prosecutors can figure out a way to make that go away and not be presented to the jury, I predict we'll see them take this up to the last instant to pressure Ersland into a plea bargain. If Ersland's legal team holds tough (= has enough $$$$), the prosecutors will drop this rather than get an adverse verdict.

This is not shocking. The jury has to be the judge of the facts. Not the judge. I hope that once this is over with they give Mr ersland a medal.

He had my backing right up until he went for the coup de grace shots. Now I hope that once this is over with they give Mr Ersland a pick and a shovel.
