The state has preemption when it comes to carry law. It cannot be more strict than what is outlined in state statute.

It can and is and until someone challenges it I'm not sure it will change until then.

Tulsa Ordinances Look at Q in sec 103.

P is goofy too! R may or may not have been violated by me and my kids!

Interesting. Calld the State AG and left a message. See what he says.

His opinion and a dollar fifty will get you a cup of coffee at Quicktrip (7-11 for you Westerners)!

I know and like Scott, but when you go to Municipal court, make sure and tell them that he said it was ok. Then when you appeal it, tell them too and then it might make a difference (not really, cause that is when preemption comes into play).

To the reOP (Teddy), if you want to be the test case, by all means, I am behind you (in spirit not financially), but when I go to parks, concealed is how I roll!

Update: Spoke with Mark Swiney, Senior Assistant City Attorney for the city of Tulsa, who was extremely pleasant and surprisingly informed. He informed me that the City of Tulsa was aware of the fact that the city ordinance conflicted with the state SDA laws and they have begun taking steps to remedy a few things. Specifically:

1. Submitted an opinion letter from the City administration to the Parks Department and the Tulsa Police Department, stating that there is a conflict between city and state law, that state law wins out, and that both OC and CC are legal in city parks with possession of SDA license.

2. Started the process of ordering replacement signage that replaces the "strictly prohibited" verbiage with signs that state the carry of weapons is prohibited unless in accordance with state law, or something to that effect.

3. Begun the process required to modify the municipal code.

Also, made the statement that we as permit holders are aware of the law and should know that the signs are not meant for us. I explained that while we are aware, most would rather not deal with the hassle to test that theory.

BTW, I only OC while at the gun store I work at; the rest of the time I am strictly CC and mostly ignore these kind of signs.
