So now they are doing plea deals for plea deals. Awesome!
No; this was a part of the only plea deal.

The defense agrees to plead guilty, saving the taxpayers the cost of a trial and the otherwise almost inevitable appeals, and the DA agrees to take the death penalty off the table. In cases like this, the death penalty is a great bargaining chip.

Ideally, I'd like to see Sweat put to sleep, so I can see a certain amount of anger, but this plea deal finally closes the case.

I think the prosecution would be wise to take the plea deal in the case of James Holmes, the Aurora CO theater shooter, as well. There, the defense offered essentially the same deal but the Boulder DA turned it down.

One of the prosecuting attys was on the news this morning (talk radio) and said the Plea deal means the judge will set the sentence (no jury trial) and said a Judge can not impose the death penalty, only a jury can do that. So its a matter of prison time only. I didnt know a judge couldn't impose death.

I'm pretty sure a jury trial is required for the death penalty to be on the table. Keephing him off death row will make it easier for another prisoner to off him. He'll probably be gone more quickly this way...

Did the prosecuting attorney state the code that says a judge cannot prescribe the death penalty?

If it is true, couldn't the judge refuse to accept the plea and force a trial wherein the scumbag can be executed?

No he did not state a code but I have heard this before I think. Its the only reason h pled guilty, he knew he would hang if a jury trial took place.
as to you second question, I dont know.
