If the guy is indeed in violation of the town's code, then he should move the sign to a legal location. But another question would also have to be answered in this case, was this "selective enforcement of the code"?

Just to inform some of the comments in this thread - the police officer in question isn't one of "New York's Finest" - that would be a member of the New York City PD - the officer here is from a small town well outside New York City.
Same point applies to the "topless rights in NYC" comment - not germane to this news report.
Just like Tulsa isn't OKC which isn't Lawton - Lake Lincolndale and Somers are NOT New York City.

On my first post, I was operating under the false impression that Somers was a suburb of NYC and the actions of the .gov officials involved sounded pretty much like something from Bloombergistan/Bloombergvania--my bad, sorry. I realize that it is pretty well known there is a world of difference in the thinking/actions of the people that live in NYC and the people that live in up state in New York State. I will have to wait and see as to what falls out when the entire story is told and all the facts are made public.

Here is something that you might find interesting on Somers, NY and their political leanings. So it would be my guess that the .gov in Somers wouldn't be that far removed from the .gov in NYC:

And while we're at it, what exactly was "Gestapo-like" about the officer's behavior??? :police2:

I have noted the Gestapo-like behavior below. Sounds like it is a .gov that does as it pleases, answers to no one and maybe has something to hide. I again say that I will have to wait and see as to what falls out when the entire story is told and all the facts are made public.

1. After a back-and-forth on his First Amendment rights with the town's building inspector he was apparently told he could leave the sign up for now.
2. Sign removed four times.
3. Gibson never received a formal citation.
4. The Blaze’s calls to the Somers Police Department and the building inspector have gone unreturned.
5. Other signs in the area that have gone “untouched.”(selective enforcement of the code)

Where's the proof of "other signs left untouched"? If he has video of his signs being removed, he should easily be able to pan over to the untouched ones for proof. If they exist.

As far as not being "cited". In most municipalities...there is no citing. The illegal signs are simply removed. I see it all the time in MWC...a lady in a pickup truck drives around all day with a rolling measuring tape and a pickup truck. She hops out, measures the distance from the curb and if it's too close she chucks it in the back and drives away.
