I found this video from a link posted in another thread. It's long...28.5 minutes long. The action happens in the first 4 minutes then again about the 10.5 minute mark. It made me wonder....are passengers (not driving) in a vehicle that has been pulled over by the police (in Oklahoma) required to show an ID to the LEO that stopped the vehicle? Ultimately in this video, the passengers were not forced to exit the vehicle or present their ID. The video was filmed in Arizona. You can fast forward to the good parts, unless you have a half hour to kill. I debated about posting this in the 2A legal, political section but there is no 2A issue in the video. BTW, I don't think the pastor was was actually threatened with the words "It's about to get more deadly". But then again, I wasn't in the car to feel threatened.

the preacher man was way more aggresive than i would be but i would have made a comment on being pulled over for a lic plate light...i think it would have been worse is the police were not getting taped...IMO, iv talked to several officers that have found people with warrants by just checking a passagers lic. but as far as being legal theres a few LEO's on this forum that could answer that...

Here are the relevant TX statutes. I know of no case law that would further expand on or otherwise contradict this



Texas Transportation Code - Section 547.322. Taillamps Required

A taillamp or a separate lamp shall be constructed and mounted to emit a white light that:

(1) illuminates the rear license plate; and

(2) makes the plate clearly legible at a distance of 50 feet from the rear.


Texas Transportation Code - Section 543.001. Arrest Without Warrant Authorized

ARREST WITHOUT WARRANT AUTHORIZED. Any peace
officer may arrest without warrant a person found committing a
violation of this subtitle.


EX CR. CODE ANN. § 14.05 : Texas Statutes - Article 14.05: RIGHTS OF OFFICER

In each case enumerated where arrests may be lawfully made without warrant, the officer or person making the arrest is justified in adopting all the measures which he might adopt in cases of arrest under warrant

TEX CR. CODE ANN. § 15.24 : Texas Statutes - Article 15.24: WHAT FORCE MAY BE USED

In making an arrest, all reasonable means are permitted to be used to effect it. No greater force, however, shall be resorted to than is necessary to secure the arrest and detention of the accused.

No, you are not required to provide ID ... However, it will get you the opportunity to go on a ride along and experience the "full meal deal" ...

From personal experience I can tell you that the ride along isn't so bad. However, your introduction to the criminal justice system at the county jail isn't gonna be any fun at all ... :shocked:

He deserves a beating for being such a smarta$$...and his buddies too. Just take the dang ticket to go about your way. This guy got himself put in the back of the car with cuffs on by running his dang mouth.

If you are a passenger and you dont have id you go to jail? :eek2: Holy nanny state batman!
