question conserning auto burglery

ok so im going to make this as short and detailed as possible almost 1-1/2 ago we bought a house in SE OKC and with in a year the house got robbed and my truck broken in to 2 times and since then we had an alarm installed adopted a BIG dog and taken several other precations but that still leaves my truck sitting out in the open i have the standard alarm from the manufactures and ive gotten my windows tinted and so my question is what happen if i actually catch some one in the process of stilling/breaking in to and stilling things out of my vehicle do i call the cops, beat the ever living crap out of them or do i use my 12 gauge and make my point ? i know that the make my day law protects me if they break in the house but what happen if there stilling or breaking in to my truck?

Well if you use the 12 ga better drag him inside your house.

Hope you were kidding because that's very, very bad advice. Even an incompetent forensics guy could easily tell if that happened. Following that advice is good for a long stay courtesy of the state at a state lockup.

If you catch 'em in the act you can indeed use your 12 gauge but only to hold them at the place the felony occured. If the robbers decide to take off in the face of that 12 gauge pointed at 'em you're just out of luck. Except under special circumstances you can't shoot 'em. The felony pointing of a firearm law exempts one in cases where you point a firearm at those commiting a felony act in your presence. So the cops won't be able to nail you with that. They might however try to nail you on misdemeanor pointing of a firearm, which law provides no exemption as the felony pointing of a firearm does though I have never heard of that happening. OK police are generally very reasonable when citizens are victimized by criminals.

There is however no provision in OK law for one to shoot another except in those cases where self defense is involved and that needs to meet the criteria of the attacker having the means, the opportunity and the intent to put a lethal dose of whoopass on you. OK does have a justifiable homicide statute which covers some wide ground and may provide for shooting a felon caught in the act (I seem to remember it covering felony acts that represent a danger to others, arson for example, but it has been many, many years since I read it and it may have changed since then.

It sucks but unless the thieves are armed and present a lethal threat to you you can't shoot 'em.

First off, your posts are hard to read.

Second off the SYG law only covers you if you are inside of the dwelling or vehicle if someone tries to enter the place. If you catch him in the act all you can do is place him under citizens arrest and wait until the police show up.

While you can hold him at gun point dont be surprised if the police are less than happy when they show up with you holding him at gun point until they sort everything out.

Uh yes I was kidding. I was saying (with sarcasm) no you can't just go out blasting away because someone breaks into your truck. :smash:

Not to be mean, but you might want to read over your post's to make sure your spelling is correct, then you might get more information,

well never said that I wus good at spelln and never really dun good in school but I gots me an I phone for when I'm away from the putter and with a name like that your one to judge spelling?
