I might be wrong, but Title 21 § 1289.25 is the only section of Oklahoma statutes that I recall deals with Stand Your Ground situations.* I don’t see any mention there of running away, fleeing, escaping, etc.

So, just to make sure I understand your position, you would not think it justified to use deadly force against someone who is running away from you while pointing a gun at you or even shooting at you?

* Obviously the incident in question didn’t happen in Oklahoma. I’m not very familiar with Castle Doctrine or Stand Your Ground in Texas.

:sorry4: Not sure where the confusion happened, but I believe I did put forward a scenario like that. And based on the conflicting news reports, we don’t know what happened. I always prefer to think of plausible justified explanations for someone’s actions before assuming the worst or most likely explanation. I wasn’t trying to trap you or anything. Just honestly wanted to understand your point of view. I’m sorry I rubbed you the wrong way.

Time was, and I think it was before Castle Doctrine really came into being, we were taught that if a suspect was running away from you, they were not to be considered a threat, even if they were still within one's home. Only if the suspect was running, was shooting back at the homeowner, and possibly that one could definitively prove that they were shooting as they were running, could one be comfortable in saying they were shooting in self defense. Otherwise, if they were retreating, it would be hard to prove they were threatening, especially if the home owner/apartment resident had no other witnesses confirming the suspect was shooting back.
