Um, it is written:

when the person first comes into contact with any law enforcement officer of this state or its political subdivisions or a federal law enforcement officer during
the course of any arrest, detainment, or routine traffic stop.

It further states:

"Contact means"

a Conversation
b A stop of a motor vehicle, whether the citizen is driving or a passenger; or
c Any arrest, for any reason

Whats it hurt to mention it to the cop on first contact.................They appreciate it, and it doesnt interfere with any of your rights per say, heck ya just might get a good conversation going with one.

whats the harm?:D

I think that is the question, though... what constitutes "contact?'

Casual encounter, where there wouldn't even be any conversation between you and them... is that "contact?"

I mean.. ya... the OP should have informed the sheriff immediately - but he corrected it as soon as he realized his oversight.

The law does not further state as such.

From 1290.8:

C. It shall be unlawful for any person to fail or refuse to identify the fact that the person is in actual possession of a concealed handgun pursuant to the authority of the Oklahoma Self-Defense Act when the person first comes into contact with any law enforcement officer of this state or its political subdivisions or a federal law enforcement officer during the course of any arrest, detainment, or routine traffic stop.

If you stop at "contact", then your argument makes sense. However, you forget the two prepositions at the end. Those must be included.

Let's break it down:

"...when the person first comes into contact" describes the action taken by the citizen. "during the course of any arrest, detainment, or traffic stop" define when the action must be taken. "with any law enforcement officer of this state or its political subdivisions or a federal law enforcement officer" describes whom the citizen was taking action.

It might be easier to understand it if we add parenthesis to separate out clauses: "when the person first comes into contact (with any law enforcement officer of this state or its political subdivisions or a federal law enforcement officer) during the course of any arrest, detainment, or routine traffic stop."

Furthermore, there is nothing about "conversation" in 21 O.S. 1272, 21 O.S. 1289, 21 O.S. 1272, or the SDA book that the OSBI puts out.

OHP has always been skittish of CCW holders.. I guess we can thank them next time we come in contact with them for helping restrain our OC options..

I don't intend on notifying a LEO I am passing in a local QT unless we stop and start conversing...

Well, you might want to look at the SDA Instructor Lesson Plan which I will be happy to show you. The lesson plan has it just the way I wrote it. Might not be in the law but it IS in the lesson plan all instructors are to use.

I serve evictions all the time and the first thing I say is "Hello I have a ccw and I am armed" they just like to know and it is better to tell them than to let them find out on there own.

I don't recall hearing that in class, but the law overrules anything that is put in a lesson plan. I wouldn't mind seeing it in print, but I'll take your word for it as there are many instructors here who can refute or support that fact.

Do you think they are going to put the definition of "contact" in the
statute...No.

Do you think they put the definition of "contact" in the lesson plan expecting instructors to teach that definition...Yes.

Good grief ... I am curious ... Are you a trooper? Are you basing your comment about OHP being skittish of CCW holders based on OSTA's stance on open carry or do you have a link to something substantial about CCW and OHP ... and by substantial I mean something like an official release from the Commissioner's Office, not a news clip of OSTA comments on open carry or ANYTHING that Nick Wiggler, errrr, Winkler had done on DPS?

Just curious ... cuz the hubby is a 20 year Trooper and this is news to him.

Oh, and BTW if you walked past an LEO in QT and said, "hey I got a CC" he/she would probably look at you like you were daft ... just saying ... :P :rollingla
