Good discussion on PAFOA, one of the better state-specific firearm forums (up there with CalCCW, and right behind OSA of course!):

http://forum.pafoa.org/open-carry-144/126083-arrested-philadelphia-police-open-carry.html

And the final details as of right now...

Currently I am charged with Disorderly Conduct and Reckless Endangerment of Another Person.

The DA's argument is that I am intentionally going around, carrying openly and using a voice recorder, trying to bait the cops into engaging with me in an inappropriate manner, manipulating them into drawing their weapons and endangering myself, the officers, and everyone nearby.

They're creative, at least.

Anyway, the lawyers have been paid their retainer fees, and the court date is currently set at

July 14th, at 9:00AM in courtroom 406 at the Criminal Justice Center in Philadelphia

Anyone who wants to come along and show support is welcome to, but please, no rioting!!

According to the paperwork, however, Sgt. Dougherty is going to be on "vacation" on this date. If he does not show up to court, we may walk in, get a continuance, and be sent on our way. KEEP THIS IN MIND if you are planning to travel a long distance to come show your support!

ALSO! And this is IMPORTANT: The FUNDRAISER thread is here:
http://forum.pafoa.org/open-carry-14...sponsible.html ([FUNDRAISER] Holding Philadelphia Responsible)

While we have the money for the retainers and even a bit extra, all further donations are gratefully accepted - when it comes time to file the civil lawsuit, we may need to pay for expert witnesses, who cost a significant amount of money. Every $5 you contribute to this fund is that much money that goes towards making sure the City of Philadelphia is held responsible for their violations of citizen's civil rights, freedoms, and liberties!!

Thanks for reading, and everyone, STAY SAFE!!

A good lawyer can get the whole thing dismissed with prejudice if the reporting officer is not available for court. And he can convince the judge to give the Sgt. a contempt of court citation.

My method is Attack, always attack and go for the jugular. Even if I am ducking and dodging always attack.

I'm with you on this one. Wouldn't an accurate record of the encounter benefit both parties. It cuts out the he said she said b.s.

isn't this why cops have recorders in their vehicles? I think he had the recorder in case sh** went bad and the cops tried to make him out to have said and acted different than actual. I heard the recording and it sounds like he didn't cooperate very well if that means obeying an order to hit the dirt just because an uninformed cop didn't know the law. He wanted to discus the reason he was being proned and the cop didn't want to be wrong. It sounded like the cop was one of those traffic cops that would approach the car that he clocked going 8mph over with his gun drawn. Then go to the station and brag about how he proned those effers out.

I'm with you, I think a recording device is smart. It keeps everyone honest.

Never underestimate the power of an ignorant jury

This

So the failure of a law enforcement agency to adequately train their officers on the law is now the fault of a law abiding citizen? What ever happened to "Ignorance of the law is no excuse."???

IF, there was a law on the PA books about failure to follow commands of a LEO, the DA might have a case. But disorderly conduct and reckless endangerment? Even with a stupid jury, this DA should get his ass handed to him by any rookie lawyer that just passed the bar. What a moron! :(

FYI, in almost two decades of law enforcement I have seen a great number of mistakes.

However I have never heard a police officer brag about proning someone out after stopping them for speeding.......

What department have you heard bragging about proning out traffic offenders?
