Driver who killed teen is suing dead boy’s family for $1 million

The family of a teenage bicyclist who died after being hit from behind by an SUV is now being sued for more than $1 million by the woman who was behind the wheel.

Sharlene Simon claims in court papers the accident caused her “great pain and suffering” and accuses her victim Brandon Majewski 17, and his two friends of negligence, calling them “incompetent bicyclists,” the Toronto Sun reported Friday.

The lawsuit drew an angry response from Brandon's family. “I feel like someone kicked me in the stomach -- I’m over the edge,” his father, Derek Majewski, told the Sun. “Sometimes, it makes my blood boil.”

The dad's attorney Brian Cameron told the Sun that in all his years as a lawyer, he had never seen anyone ever sue a child that they killed. “It’s beyond the pale,” he said. He is representing the elder Majewski in a seperate lawsuit that seeks $900,000 in damages from Simon.

The accident happened early in the morning of Oct. 28, 2012, on a dark, rural road in Innisfil, about 55 miles north of Toronto. Brandon’s two friends were both 16. One was seriously injured; the other escaped injury. They are also defendants in Simon’s lawsuit, as is the county where the accident occurred.

Simon, a 42-year-old mother of three, said she was going about 55 mph in her KIA Sorrento when she hit the boys -- about 5 mph more than the speed limit, the Ottawa Citizen said. No criminal charges were ever filed against her.

“It’s a tragedy what happened to the boys, but it’s also a tragedy that’s happened to (Simon),” her lawyer Michael Ellis told the Toronto Star. “I understand their grief and I understand what they must be going through is awful, but my client is also living with this nightmare every day.”

It's made the rounds on reddit. The families sued her first so she basically countersued them. There's a lot to the story that wasn't included and a lot that only a few people know. I reserve judgement until all the facts are out.

Well, she was not charged with anything so it makes you wonder, it also sounds like the boys had some negligence too, shouldn't have even been out there. Its terrible what happened and now it just won't go away.

I like this comment from the news story.
Wow.. if there was ever a face for the word c#nt, this women is it. It's people like her that make this world such a crap hole to live in..

Kind of depends on the outcome and the way you tell the story.

Still, it's good to know when we can trust our otherwise incompetent government to bring out old sparky.

I bet God knows who's at fault. I wonder if there will be bicycles and cars in heaven? I mean what's point of golden streets if we can't drive on them? Where do the golden streets lead to? Hobby Lobby and that chicken place perhaps?

I wonder if Joel Osteen's house will be bigger than mine if we both get to heaven? Will the "cave" men live in caves or do they get a house too?
