I wonder if he had them in plain view or what. I would think they only found the mags if they were in plain view or he consented to a check of his vehicle. Either way I think he could be able to sue for probable cause.

I'm not leturing you, I'm responding to your post about the double standard. But since you want to get pissy...Do you know all the facts? How do you know he truly believed they were made before '94?

It sucks for him, but if you live in New York, you damn sure better KNOW that what you possess is legal AND that the double standard you mentioned does exist.
It's hostile territory. Operate in it at your own risk...but do it smartly.

Ah yes, let's resort to name calling. If you read the article, it was stated by his brother that he believed the magazines were made before the 94 ban, making them legal to have in New York.

If you go to the donation web site Michael Haddad says his brother broke the law. Here is an excerpt from his message:
my only intention with starting this online donation site was to help my brother. he was arrested because he broke the law. that is something that neither he nor i dispute...

Thanks for pointing that out gmplaster. That's the saving grace here...at least he is not whining about it.

Hopefully he can get it worked out with as little damage as possible...and the case can be used to highlight how dumb the law is.
