BREAKING: Federal Judge Strikes Down Interstate Handgun Transfer Ban

In a ruling issued today, a Federal judge has declared that the longstanding ban on gun dealers selling handguns to residents in different states is not only unconstitutional under the Second Amendment, but also violates other fair trade provisions of the United States Constitution.

Wow!

Wonder what that will do for gun sales, person to person, from out of state. Example:

I find a gun in Dallas that an individual has for sale, and want to meet for a FTF.

I love reading decisions like this. Bravo CRKBA! If this holds true, gun sales are going to boom in CA; lots of firearms cannot be obtained because companies won't jump through the hoops of getting them on the "safe to buy roster."

It looks to me like the requirement to receive handguns only in your home state was struck down, and a person can therefore buy from any FFL, as long as the laws of both states are followed. Interestingly, the BATFE recommended dropping the struck part several years ago as obsolete due to insta-check, but congress failed to act.

Yep, as long as state laws are followed(which may prove to be a hurdle for the CA safe roster; state law). Also, this is just an injunction and will not be valid as soon as it is appealed. It would have to go through the 5th circuit as well as SCOTUS to be law of the land(although making it through the 5th would at least set precedent).

Thats great, it would sure be nice to be able to buy a gun from the bigger stores in Fort Smith, AR vs the small time pawn shops here in Poteau. Nearest "big" gun store is Tulsa, a 2 hour drive.
