Yes we know the officers were wrong. But the truth is it was minor in the scheme of things. They slightly inconvenienced the guy and 3.6 million is stupid. They did not shoot him or beat his ass....that would have been worth big $$$$. The world needs more common sense.

And the world gets it by answering severely for the mistakes they make. You're child messes up big time, what do you do? Spank him/her, or go buy him/her an icecream and tell them that what they did wasn't so bad. Not I, sir... And you don't have to agree with me. But giving slack is the reason why they continue to push. If you punish them so severely that they know not to do it again, then you wont have this problem again, at least in that municipality...

What I want to know is what the OC guy was carrying, and what the LEOs were carrying. And why they chose their specific handguns. Also, what gun leather they were packing their heaters in.

The perfectly Legal handgun owner had a keltec elsie p. in a Don Hume slide, his Grandson gave it to him for fathers day, because he raised him like a son.
The Officers had their normal Glock 29's in theyre duty rigs, cause that's what they were issued....

I thought it was interesting that they could verify he had a CCW. I understood that OK police have no access to the CCW list which is one of the reasons we have to have it on us when carrying.

Interesting question. I know HyPo can access that list, and just assumed any LEO could.

You need to read the Constitution. I'll give you a hint. Skip ahead to the 4th Amendment. Doesn't matter if it's out in public, you still need probably cause, which apparently you don't know what that means either. The officers themselves admitted that they didn't have any probable cause.

And, no it wouldn't be my job to verify if someone carrying a gun is a good guy or a bad guy unless the law gives me the ability to do so. Clearly, according to Ohio law, open carry of a weapon is legal and there is no law giving officers to determine the status of anyone carrying a weapon. So my response would be, "Are they committing a crime? Do you have reason to believe that they are about to commit a crime? No. Okay, well, carrying a weapon openly is legal in Ohio. Have a nice day". That's the law. Going to this scene and harassing a law abiding citizen is outside the bounds of the law and the officers were not "just doing their job". If you don't like it, then work to have the laws changed. If you think officers should be allowed to check the status of anyone carrying a weapon, that's fine, but it's not the law of the land. Get the law changed to suit what you like.

Besides, wasn't the argument of "just doing my job" or doing what I was told abolished at Nuremberg?

While he was within his rights he showed an incredible amount of stupidity. In this day and age of terrorist attacks, armed robberies, etc, etc. the police were within their rights and responsibilities to try and find out if he was legal to carry. If he had not been and committed a crime after being let go someone would have tried to sue the police for that.

There has to be a reasonable balance of the police being allowed to check while still protecting the citizens rights.

I agree with RickN. I figure most of the time the best thing to do is comply with the LEO's request for ID. Most of the time a LEO's primary goal is to eliminate threat. I'm no Abbie Hoffman. I just want to get things taken care of so I can be on my way and the LEO can get on to other more important things. And in the real world I bet 90% of the people reading this thread would do the same thing.
