OK Emergency Powers and Firearms

§21-1321.4. Acts which may be proclaimed prohibited - Actions at law or in equity
A. The Governor during the existence of a state of emergency, by proclamation, may, in the area described by the proclamation, which proclamation shall not cover any part or portion of the state not affected by public disorder, disaster, or riot at the time the proclamation is issued, prohibit:
B. Notwithstanding this section or any other law of this state, neither the Governor nor any official of a municipal or state entity shall prohibit or suspend the sale, ownership, possession, transportation, carrying, transfer and storage of firearms, ammunition and ammunition accessories during a declared state of emergency, that are otherwise legal under state law.
D. Any individual aggrieved by a violation of subsection B of this section may seek relief in an action at law or in equity for redress against any person who subjects such individual or causes such individual to be subjected to an action prohibited by subsection B of this section. In addition to any other remedy at law or in equity, an individual aggrieved by the seizure or confiscation of a firearm or ammunition in violation of subsection B of this section may bring an action for the return of such firearm or ammunition in the district court of the county in which that individual resides or in which such firearm or ammunition is located. In any action or proceeding to enforce the provisions of this section, the court shall award the prevailing plaintiff costs and reasonable attorney fees.

OK2A-Kay County Meeting Suspended



Oklahoma 2nd Amendment Association-The State’s Leading Advocate for 2nd Amendment Rights and Liberty Group has suspended its meetings due to the Emergency declared in the State and Ponca City. Meetings are the 4th Saturday of each month @ 12;00 Noon at New Hope Christian Fellowship in Ponca City. There will be no meeting in March - we plan to be back on schedule for our April 25th meeting. With President Trumps declared a National emergency . That is the action of total panic and hysteria so now we must learn about the "STAFFORD ACT"

Pay attention and know your rights during this National Emergency.

Under the Stafford Act:

Sec. 706. Firearms Policies (42 U.S.C. 5207)
(a) Prohibition on Confiscation of Firearms - No officer or employee of the United
States (including any member of the uniformed services), or person operating
pursuant to or under color of Federal law, or receiving Federal funds, or under control of
any Federal official, or providing services to such an officer, employee, or other person,
while acting in support of relief from a major disaster or emergency, may -
(1) temporarily or permanently seize, or authorize seizure of, any firearm the
possession of which is not prohibited under Federal, State, or local law, other
than for forfeiture in compliance with Federal law or as evidence in a criminal
investigation;
(2) require registration of any firearm for which registration is not required by
Federal, State, or local law;
(3) prohibit possession of any firearm, or promulgate any rule, regulation, or order
prohibiting possession of any firearm, in any place or by any person where such
possession is not otherwise prohibited by Federal, State, or local law; or
(4) prohibit the carrying of firearms by any person otherwise authorized to carry
firearms under Federal, State, or local law, solely because such person is operating
under the direction, control, or supervision of a Federal agency in support of relief
from the major disaster or emergency.
(b) Limitation - Nothing in this section shall be construed to prohibit any person in
subsection (a) from requiring the temporary surrender of a firearm as a condition for
entry into any mode of transportation used for rescue or evacuation during a major
disaster or emergency, provided that such temporarily surrendered firearm is returned
at the completion of such rescue or evacuation.
