You're still wrong read the statute its agnostic of the amount of force used , be it a finger, fist or hard shove . The minute the old man told him to shut up and touched him it was game on. The cop could have and should have used more restraint , but the old man commited a felony

I don’t think you understand what I was saying, I’m in complete agreement with you. That was my point. The guy said he shoved the cop when all he did was touch his vest…. Geez
I know, I know, I directed fire to the wrong coordinate , I apologize, I'm old and confused, I should have been body slammed like all 80 year old men. I wish you the best.

Ok, so he should have professionally arrested the tiny old man and the DA could file felony charges against him for touching the cop with his fingers.

But he didn't. He lost his cool and overreacted.

I think he should be fired, and face the same charges as the old man. The level of physical aggression which resulted in such a gross injury, outweighs the normal legal protections provided by civil code. Circumstances are everything.

I'll type slow for you here.
I'm not arguing the statute but some common sense on the part of the cop was WELL in order. I don't give 2 shits if he got pissed that the old man told him to shut up. Cop was NEVER in any danger and possibly talking to a man with mental difficulties.
(Maybe I am to).

If there are no consequences, then why can't we all just bully police and get away with it which leads to violent crimes against police increasing.
I see that every day in liberal states where officers are pushed and shoved with impunity by "social" protesters in the streets. They have no respect for the law because they are not punished for what they did.
All that pontificating behind me now, I do think the cop in the OP went too far. Yeah, the guy probably should have been arrested and it wouldn't have been an issue to turn him around to cuff him as he said he was ready to go to jail.
The little tap of the back of the hand on the officer may or may not have been an act of aggression.
I have a couple of friends that want to tap me every time they want to make a statement. It irritates me because I'm sometimes having a conversation with another person at the time, but it's a habit of theirs. I don't take them to the ground for doing so.
The officer could have given a harsh verbal warning that if you touch me again, you're going down. If it did happen again, he would have got the treatment in the video.
That's called de-escalation. It can be very effective.

I have all the common sense in the world, and know better than to NOT do what that old man did . But again you can't seem to make that connection so who here actually has some inability for critical thinking. I am not gonna give you a pass either if you do what the old man did , but I'd hope you know how to be quiet sign the citation and then goto court.
