The old man crossed the line when he was arguing with the officer, the got right up in his face and poking his finger into the officer. The Officer then went form trying to handle it verbally to by hand, the next step and he used enough force to stop the confrontation, it was just a little to much. You do not argue with someone and then poke them and not expect to get your az handed to you unless you are a Ninja or something.
When government authority is one of the parties involved, the Constitution and the courts disagree with you.

In this case the idiot cop Will lose in all cases. He’s toast so the department will find against him and he’ll be on the streets looking for employment. The city will settle out of court . Any sugar coating as stated will be humiliating for the sayers.
