I have a related question for anyone who might know.

Does what is termed as a "mutual restraining order" that judges sometimes put language for into divorce paperwork count the same as a real VPO when it comes to USC 922? It's not a real VPO but just a line or two for both parties to not harass, stalk, etc.. contained in the decree.

It's true that a Final VPO does prohibit firearm AND ammo ownership. A temporary one that is granted Ex Parte does not. There has to be an actual represented hearing scheduled and completed where the accused has the opportunity defend themselves in court for it to become final.

a restraining order is not the same as a protective order

Ya I know, but the language in 922 doesn't make any differentiation as to what the order is called.

The reason I ask is because my ex is trying to get me to agree to a mutual restraining order mentioned in the custody paperwork in a counter-offer for settlement that her attorney sent over. If it doesn't effect my rights, then it's a non-issue, but if it does, then I have to refuse that language completely. My attorney thinks that it WOULD prohibit me from answering no on a 4473 in the future, but I don't know if I have the final researched answer yet.
