Not a good day for gun owners and supporters of liberty. I read a summary earlier of Thomas's scathing dissent (along with Sotomayor) that the court overreached its authority by applying restrictions to a right that it wouldn't if the issue were not guns. During oral arguments he even broke his traditional silence and asked what other rights can be denied as the result of a misdemeanor.

A family member of mine was married to a woman that was mentally ill. She went to the county sheriff looking to press charges for bruising that occurred during an altercation. I know this did not happen as it is not part of his nature, furthermore, I was WITH him at the time the incident was said to have taken place. Needless to say, nothing came about that.

Now to think, if this happened to him it could happen to anyone. He was fortunate that he lived in a town in which the Sherif knows both him and her and also that I was with him at the time that this supposedly went down. To think now he could have lost his constitutional right and joy of owning firearms, based largely on a false accusation of crazy person... That is not right.

I don't know what the answer is, but this is not it.

Charges are filed based upon false allegations all the time. I see it at the courthouse on a daily basis. If there is no third party witness, or independent proof, the guy loses the swearing match every time. I recently had a guy charged with kidnapping and domestic A&B. The girl claimed he held her hostage over the wknd and thumped her around. Victim forgot they went to Blockbuster over the wknd and she used her card to make purchases. She also forgot about the surveillance cameras. I obtained the records including the video and the state was forced to dismiss. But for the video and receipts my client would have been convicted. It can happen to anyone. Very scary.

So what happened to her for making up false charges that could have screwed this guy's life completely over? Nothing I'd bet. If she got ALL of the consequences that she was attempting to make him pay brought down on her head this nonsense would come to a screeching halt.

Bad day for gun owners. Disgruntled spouse can go file for a protective order, and in fact some divorce attorney's advocate doing that right off the bat no matter that nothing has been happening. I guess they think it makes the spouse filing have the initial hand?

Nothing happened to her. Pure B++++++t.

Accusations of domestic violence happen every day. I haven't looked at the laws in some time, but it seems that just the mention of domestic violence without any physical contact is enough to send a guy to jail.

I've responded to domestics and seen some guys that were really scratched, cut and bruised, but the women who did it were never charged.
