He doesn't have to have the votes in Congress. An AWB could easily be enacted by a Presidential Executive Order. He could declare it a matter of national security and public safety. It could be that easy. And since he's a lame duck president he doesn't have anything to lose by using an Executive Order to accomplish this.

Today I learned that you know what "lame duck" means or what the limits on executive orders are.
