When someone kicks in someone's door and enters without identifying themselves, they might get shot. Many LE agencies require college degrees, but common sense may not be in the core curriculum. This victim may have thought it was other drug dealers after his stash.

The only thing that No Knock warrants mean is that they don't have to announce themselves when they initially breach the door but then they usually immediately identify themselves once they do. Nothing in the article indicates how they served it and it sounds like they favored the criminal more than the LEOs and that he was just a good guy protecting his family. Getting a Judge to sign off on a night time as well as a no knock warrant shows that the Officers had reason to believe that there was an elevated safety risk or chance of the evidence being destroyed.

somebody knocks down my door, or blows out my windows, in the middle of the night, i'm not gonna take them at their word if they say they're cops. they're invading my home, and its my job to defend it.

Every home should be considered to contain a firearm until proven otherwise. As for the destruction of evidence, how quickly can a person flush 15 live pot plants down the toilet?

It requires very little critical and analytical thought to debunk those justifications in a case such as this.

What was the victim to think? Someone kicked in his door at oh dark thirty without identifying themselves. He very well may have figured they were thieves coming for his stash.

A judge found that there was probable cause to issue a night time and no knock warrant so they were legally there no matter what one's opinion of the case is. Not sure how Texas prosecutes their cases such as having to go in front of a grand jury before it can be prosecuted or if their DA's can file the charges. Don't have enough facts on how it was served and why they went the grand jury route. I reckon that they could file lesser charges such as felony murder or 1st or 2nd degree murder. I'm surprised this d-bag survived the search warrant after murdering the Officer though.

Everything was Legal Debbie Spiegal, but the deputy is dead because he kicked in the door unannounced. Remember a year ago or so when that drug fiend did that to the widowed mom's house trailer and she shot him with a 12 gauge slug? Some of these officers have college degrees, and ought to know better. Heck, that guy didn't know it was LEOs, he thought it was thieves trying to take his dope.

there were in excess of 50.000 warrants served by SWAT teams last year....a good portion of those were for non violent offenses....this is a perfect example of militarizing the local PD's....The SS and Gestapo come to mind....
