The IRS is claiming that although they have Lerner's online mail (her exchange mailbox was limited to 1GB in size) IRS employees old mail was archived by agency policy to local disk drives and it's that archive file that was lost in the crash.
It's a plausible story as far as it goes.

What it ignores is they are supposed to be running email retention software on their exchange server in order to comply with FOI requests and it sounds like maybe they aren't.
I can see why might not back up employees local disk drives but there are several software solutions that run on exchange servers to preserve incoming and outgoing mail.

I think investigators are looking in the wrong place though.
If Lerner believed she was doing anything unethical or illegal she probably wouldn't have used the internal agency mail system to do it.
She would have used an external mail system of some kind that was seperate from IRS internal systems.

You might remember how a hacker gained access to Sarah Palin's Yahoo email account in 2008 and the bridgegate emails that are giving Chris Christie an ulcer are from Bridgette Kelly's GMail account.

Investigators should be serving subpoenas on yahoo.com, gmail.com, and hotmail.com to find out if Lerner had an account on their mail server and if so does it contain any IRS related correspondence. IMO

Hobbes, investigators already know the emails were there. They have evidence and testimony on record of it.

This is purely one of these ---> :finger: from the administration. They don't care what anybody thinks, they are going to do what they want. Until somebody figures out how to get Holder to start charging and trying people for their crimes that is.

No, what they have are emails from Lerner that are ambigious enough to be interpretated more than one way.
The email Issa was exploring at the last committee hearing, for example, was one in which Lerner referred to "the Citizens United problem".
Now that could be interpretated two different ways:
It could mean that the citizens united SCOTUS ruling has had the result of a lot more dark money funding conservative groups.
Or, it could mean that the citizens united ruling resulted in hundreds of more 501c4 applications and the IRS couldn't keep up.

They are going to have to find something a lot more incriminating than that if they expect to prosecute anyone.
If Lerner sent any email more incriminating than that it probably wasn't thru the IRS internal email system.

The I.R.S. told congressional investigators on Friday that two years’ worth of emails sent and received by Lois Lerner, the former official at the center of the inquiry, had been destroyed because of a computer crash in mid-2011. The committees are examining whether the lost emails involved obstruction or a violation of the Federal Records Act, aides to the committees said.

You're the one not paying attention.
They aren't saying they had the emails that are known and then lost them.
They are saying there are unknown emails that were stored in her archive that were lost but the emails already produced are still available.
