The email Issa was exploring at the last committee hearing, for example, was one in which Lerner referred to "the Citizens United problem".
Now that could be interpretated two different ways:
It could mean that the citizens united SCOTUS ruling has had the result of a lot more dark money funding conservative groups.
Or, it could mean that the citizens united ruling resulted in hundreds of more 501c4 applications and the IRS couldn't keep up.
They are going to have to find something a lot more incriminating than that if they expect to prosecute anyone.
If Lerner sent any email more incriminating than that it probably wasn't thru the IRS internal email system.

There are all kinds of federal violations going on by more than just Lerner. The FRA requires all records be kept. The FOIA probably has additional requirements. Bottom line is IRS has already said they had them. Key word being "had"...
