Do judges usually issue acquittals before the defense has made its case?
Is this your first rodeo? I mean, really. What idiot on what TV network is telling you
that the judge could issue an acquittal?


It doesn't happen very often, but if the judge believes the prosecution has failed miserably to prove it's case, the judge can infact acquit.

I would have bet my life savings that this judge would not dismiss the charges. The prosecution's case sucked big time. Most of their witnesses scored points for the defense even before the defense questioned them. I kept waiting for the hammer to drop and it just didn't. Even the mother didn't sway anyone. Weird, weird trial.

I still can't get over that M.E. It was like he just got off the boat (or crawled over the fence) yesterday. Strange guy. And, NO, you can't see my notes!

If you guys will remember, initially the police chief & prosecutor declined to press charges, then the outcry started, led by the President.

This was a case of self defense, and it's been clear from the get go.

If this guy is convicted, and I fear he will be, the justice system will have reached an all time low, and that's sayin' something.

I dont think they will convict but they are going through all the hoops with publick display to show he is in fact innocent so public outcry in the black communities may be minimal.
This is a dog and pony show for the blacks.

Also remember that the lead investigator, Chris Serino, was also pressured to bring charges (he wanted manslaughter which actually might have been proven) and has now been demoted to patrolman (http://lawofselfdefense.com/zimmerm...ris-serino-demoted-to-patrolman-by-superiors/). The handling of this case is such a farce and a real testament of how politics and justice don't mix.

It wouldn't be an acquittal, it would be dismissal of the case, either with or without prejudice. Perhaps you should search some caselaw before making such a silly statement. :)

She can dismiss it, or declare a mistrial. Neither of those things is an acquittal.

The defense filed and argued a motion for acquittal. The judge could have ruled in favor of the defense and entered a judgement of acquittal.
She did not.

"A motion for judgment of acquittal is a criminal defendant's request to be acquitted. Such a request is made at the close of the government's case or the close of all evidence. A motion for judgment of acquittal is made when there is no legally sufficient evidentiary basis on which a reasonable jury could return a guilty verdict. In case the motion for judgment of acquittal is granted, the government has no right of appeal."
