How does Martin know Zimmerman has a gun? The only way he would know is if Zimmerman had drawn down on him. I would believe if Martin had seen a gun, he would have fled rather than go fist fighting with a man that had a gun drawn.

I guess judging by your post it is acceptable to beat the **** out of anyone that is following you. I'm sure Martin would have been on the defensive about some dude following him but just because someone is tailing you does that give you the right to attack?

Are you saying Martin is a "dog"? Do you have evidence that Zimmerman had him "cornered"? Do you have evidence that Martin knew Zimmerman had a gun?

Why couldn't Martin have called 911? He had a phone in his hand, didn't he? Do you have evidence that Zimmerman was "running" after Martin?

This case is fraught with speculation. You speculated that Martin knew Zimmerman had a gun and felt cornered. Many unknowns in this case but it has been reported since day one as a kid gets profiled and gunned down by a larger, grown man. Reality and facts have had very little bearing to this point.

So by your interpretation, you give up the right to self defense if you first flee? Or just that SYG does not apply if you first flee? In which case you still have a right to self defense under the laws previous to SYG. I can see no scenario where you would lose the protection of the law if you practice lawful self defense. I think you are taking things a little bit too literally without regard to the intent and practice of the law.

Never said he GAVE UP the right to self-defense due to fleeing. I stated SYG does not apply IF one flees first. IT DOESNT NEED TO BE APPLIED.

AGAIN... SYG states you do not have to flee. When someone flees first, then is forced to defend themselves, they are in a much better legal position than what is covered under SYG because they tried to flee first.

One more time....If someone assaults you, you flee, they follow and attack, you defend yourself, SYG does not apply because it does not need to and it does not fit the criteria of the law. SYG only applies when one in fact....STANDS THEIR GROUND at the onset of the attack.

Where Zimmermans trouble may lie is that he could be perceived as the agitator and brought the attack on himself. However, the other side of the coin is that if he was simply reporting suspicious activity and being in a place he has a legal right to be , was then attacked, stood his ground and met force with force then he would have the protection of the law.

I tend to view "stand your ground" as a silly bit of legislative overkill if it is already lawful for one to exercise self defense. It's probably not a popular opinion to have on a shooters forum, but it seems like "stand your ground" laws are really more "stick it to the man" laws.

No, not a popular opinion here, but a respected one. :respect:

SYG may be "overkill" but when it comes to being criminally/civilly charged with the chances of prison or financial ruin, I am glad there is the extra specificity that protects me. I dont trust my life to a wishful optimistic interpretation.

Exactly...some folks are missing that point. We aren't prosecuting the case...just shooting the breeze in a tech version of the barber/coffee shop.

I've never figured out why when in a "conversation" here someone will get their panties wadded up and throw out the post count thing. This guys here (the vast majority of them long gone -- or just lurkers -- now :cry11:) would chitty-chat all night long. We had some downright EPIC threads here ... and they were all hysterical. I spent many nights laughing so hard I was crying ... :kiss:

Oh ... and I have no idea how this one's gonna go ... All I know for sure is that convicted or not Zimmerman's life has been FUBAR'd beyond belief -- first, when he shot the kid (whether it was self-defense or not) and second, when Travon's Mommy and Daddy decided their less-than-perfect angel's name needed to be trademarked ...
