Anywhere the dog goes, the owner is responsible for its actions. Even if someone jumps into a fenced yard and the dog attacks, the dog owner is liable.

Anyone have an update? Hope this kid can recover.

errr... that's not quite true. recently in Tulsa, a meter man jumped a fence and got mauled by large dog.

ruling ... dog was simply doing it's job by protecting his yard.
end result neither dog or owner got in any trouble.

Been that east a long time. A buddy of mine trained schutzund in the 80's and 90's more than one person got their ass ate jumping into his yard including a police officer one time and he was never held liable for the actions of the dogs in his yard.

What about the other side of it also? Where was the person watching the 2 year old? Where was she that a dog that size was able to have access to her?

There really is no other side to it.

I like pits , but , I could never own one due to the liabilities.

I had a buddy that used to be a meter reader for ONG. He said he was bit by labs and chows and that was a bout it besides a couple toy breeds. His rule was Dobies, shepherds , or pits go ahead , but , if a lab or chow was in the yard just estimate it. One of the pits that we use to gaurd our scaffold yard got after the Bixby telephone guy. Telephone guy jumped in the bed of my partners brand new Tundra and kicked a big dent in the side of it. He was furious about it . He wanted BTC to pay for it. I told nim to lighten up we have ins. and I am sure tha it wouldnt be more than a couple hundred bucks to fix it. Then BTC called the sheriffs dept and wanted some action to be taken. The TCSO told them no way the dog is free to roam wherever on the acreage she wanted to. Then my business partner said lets sue them. I said no its over take the truck to the body shop and call it a day.

There is criminal action and then there is civil action. His homeowners would have cancelled him immediately had they known what kind of dogs he had. There cant be criminal liability in a case like that if the dogs were in their yard. However , should someone want to take civil action against him then that could play out a little different.

I had a few buddies that used to train schutzund. My buddy Chris was a bite guy. He was the one getting chewed up by the dogs when demonstrating.

If he trained in the 80's and 90's he probably knows my buddy Al.

Hmmmm ... that's funny. I have a Level III Shutzhund champion from Germany. If she has been introduced to you she will lick you to death. If not, she will watch you like a hawk and raise nine kinds of hell, but she has not bitten someone unless she was commanded to or they had put hands on me.

She has cornered the meter reader, but she didn't try to bite him. He didn't try to attack her or me, though ... I don't think I would have a dog that I knew would bite someone just because they came in the yard.

I trust her instincts more than my own and have never had to worry about her biting someone when it was not necessary. If she gets in between me and someone I know I need to pay attention. But again, she doesn't bite just because ...
