Are pistols firing shot shells legal in Oklahoma

Same discussion they've had on the Tac14/Shockwaves as the OK definition of them (pistol/shotgun) differs from that of the Federal Governments definition of them. There's a LONG thread about that, which pretty well applies. Make your own decision.

Didn’t Jerome Ersland use a Judge during the initial part of his confrontation? Don’t know if it was using shot shells or not?

Yes, and he was using shotshells.

One of the best cases representing the use of it where it and an additional felony was not stacked on.

However this was in the where he shot the robber on initial engagement. One pellet struck him in the head.

The actual murder charges came from his return, retrieving a second handgun (don’t remember the caliber) and shooting the already “incapacitated” robber.

Oklahoma TITLE 21 § 1289.3 DEFINITIONS FOR FIREARMS ACT "Pistols" or "handguns" as used in the Oklahoma Firearms Act of 1971 shall mean any firearm capable of discharging single or multiple projectiles from a single round of ammunition composed of any material which may reasonably be expected to be able to cause lethal injury, with a barrel or barrels less than sixteen (16) inches in length, and using a combustible propellant charge, but not to include flare guns, underwater fishing guns or blank pistols.


Oklahoma TITLE 21 § 1290.2 DEFINITIONS A. As used in the Oklahoma Self-Defense Act: 1. “Concealed handgun” means a loaded or unloaded pistol or handgun not openly visible to the ordinary observation of a reasonable person;

2. “Unconcealed handgun” or "open carry" means a loaded or unloaded pistol or handgun carried upon the person in a holster where the firearm is visible, or carried upon the person using a scabbard, sling or case designed for carrying firearms; and

3. “Pistol” or “handgun” means any derringer, revolver or semiautomatic firearm which: a. has an overall barrel or barrels length of less than sixteen (16) inches, b. is capable of discharging single or multiple projectiles from a single round of ammunition composed of any material which may reasonably be expected to be able to cause lethal injury, c. can be held and fired by the use of one or both hands, and d. uses a combustible propellant charge to propel the projectile or projectiles.

.....ergo I so no legal prohibition against pistols that fire shot shells in Oklahoma.

Ersland used a Judge loaded with 45 Colt and 410 buckshot loaded in alternating order. The round that incapacitated Parker was a 410. One pellet struck him in the head and traversed the brain but did not kill him. The second weapon was a Kel tec P3at 380 acp.

I have never heard of an issue with the rifled barreled pistols. There was some concern whether the Tac14/Shockwaves were legal under Oklahoma statute.

If I remember correctly, OK2A addressed this a couple years ago and successfully changed the language making multiple projectiles from a pistol legal. Didn't follow it closely then so I could be mistaken although I do remember it being discussed by OK2A leadership.

Maybe we need OK2A to respond. I think the head of that organization was a member of OSA back in the day. I think some of our more radical members from that period ran him off if I remember right.
OK2A has a presence on the book of faces, but I don't go there.
