The owner of the car is looking to get into more trouble for his actions than the guys that drove his car. It may not seem right but only one party has broken a law here.

Joyride is completely inexcusable - and that's one of the reasons I own my shop and a dyno! If a customer has complaint - I just go with them on a drive, customer behind the wheel.

On the flip side - the invasion of privacy is plain criminal! The fact that some of you are "ok" with it - simply boggles my mind.

P.S. If anyone cares, here is my observation (from professional point of view)

The car came in with 39k and "the gears would grind" problem. Wear on the disk really depends on the driving technique - and 39k isn't' really out of norm, especially for a 4000lb SS Camaro with 426hp; basically what I'm saying it needed a clutch job anyhow.

Dealership offered him free pressure plate (drivetrain warranty) and owner pays for "disk" - which is a normal wear part: sounds like a fair offer.

I am not defending the "joy ride" in any sense; but we are listening to one sided story - he says "parking lot speeds" - who's there to say that he didn't tell mechanics that the problem happens on high-rpm one-two shift? which than indeed would require spirited driving.

Either way - the dealership should take care of the clutch, and the guy should have criminal charges for invasion of privacy - just my $.02

I have to disagree with this part.

I have to disagree with this part.

Which part of "this part"? The part that the clutch was "needed"? Again, I guess it depends on a person - some people don't think they need a clutch till the car can't move anymore, some people address it when the first symptoms of slipping/hanging/hard engagement show up.

The car came in with 39k - FACT
and "the gears would grind" problem. - FACT
Wear on the disk really depends on the driving technique - FACT
and 39k isn't' really out of norm, - I've seen factory clutches let go as soon as 10k and last as much as 150k
especially for a 4000lb SS Camaro with - FACT
426hp; - FACT
basically what I'm saying it needed a clutch job anyhow. - personal opinion.

A deal was struck. The dealership bought the car from him at above market value. They will auction the car off and donate the proceeds to charity. The guy will donate the profit the dealer gave him to charity as well.

A deal was struck. The die has been cast. Hannibal has crossed the alps.

Back in 84-86 I had a 71 pontiac lemans sport. 2 door, hard top, 455. That beast would move. Due to my work scheduale I dropped it off at the local tire shop to have them do some brake work for me. Came in the a few hour later to pick it up while on lunch, got there in time to watch as my car was backed out of a bay, them promply had the tires lite up for a block and the mechanic taking a hard turn and going balls for the walls down the road. The manager of the shop stood there watching then asked me what I was needed, I said my car that just drove off back here right now. His face went pale. mechanic came back grinning as he walked thru the doors and said damn that car will run, I said ya she will, she is mine.
They both got a verbal thrashing and I actually got some free work done. Still pissed me off, never used them again.

The car isn't a bathroom. They should have no expectation of privacy in the guys car, he was free to record the goings on inside the car while it was in their possession. No warrant needed, and he isn't the cops. You can record a nanny taking care of your kids in your own home, business owners can record the goings on inside their business. And, as a matter of law, in a public bathroom, one does have a reasonable expectation of reasonable privacy, but only up to a point. The federal courts have upheld and agreed, there is no "Absolute Right to Privacy" in a public bathroom. People have a right to a reasonable expectation of privacy in a public restroom, you can't be recording the toilet in order to cop a peek, but you can record other areas of said restroom in an effort to curtail criminal or illegal behavior.

Anyone remember the couple that got busted in the football stadium bathroom for having sex and snorting cocaine? They were actually in a stall, but they had no expectation of absolute privacy inside that stall, and in fact were arrested and charged.

The guy was okay to record this conversation inside his own vehicle, if he had set the recording up inside the dealership somewhere it would be a different story. He didn't. It isn't. He was legal. You ever wonder why Dateline, or 60 Minutes, or any other investigative news show hasn't been busted for leaving a car with a mechanic with hidden cameras in it for the purpose of recording them scamming them on repairs? Because it isn't illegal, that's why. Your opinion may differ, and you're certainly entitled to your opinion, even if it's wrong.
